Grenada's
female resident High Court Judge Justice Charmine Pemberton on Tuesday
landed a ten (10) year jail sentence on a 23 yr. old Mt. Parnassus man
after he was found guilty of Indecent Assault. Franklyn Borris was handed
the stiff sentenced for the
indecent assault of a 5 year old girl in 2001.
When the matter begun on Monday
Senior Crown Counsel at the Director of Public Prosecution (DPP's) office
Mr. Darshan Ramdhanny gave a detailed outline of the Crown's case which he
intended to prove. He presented the Crown's case with the aid of
the Prosecution's witnesses, before a nine member mixed jury at the number
two High Court in St. George's, presided over by the Lady Judge.
The prosecution stated that
Borris had attempted to sexually assault the child at her Mt. Parnassus
home on the afternoon in question.
Grenada Today gathered that on
the day Borris committed the offense he had seen the victim's elder
brother lower down the road and proceeded towards the victim's home in
search of her brother.
It is believe that the defendant
then went inside of the child's room where he attempted to have sexual
intercourse with her but was unsuccessful.
Reports are that Borris fled the
house un-noticed, when he heard the child's mother calling, as she entered
the yard.
The child whose name has been
with-held, is said to have called out to her mother and then reported to
her what Borris had tried to do to her.
The mother claimed that her
daughter told her, to come and see what Franklyn had tried to do to her.
The child she explained said, "Frankly tried to rape me''.
However following the Jury's
decision and Judge's sentencing of Borris on Tuesday afternoon, the mother
of the victim told reporters that she could have been the one going to
Prison today, if she had caught the accused in the act.
''He is very lucky I did not
meet him. Besides which I had just given birth to a baby, and the Doctor
had to cut me, or else like I told the Police I would have dealt with him
myself''.
She noted that she was happy
that justice had taken its course and said that she got justice for her
child.
Borris wept as he approached the
police transport.
